AFAIK, TrueHD tracks usually have an AC3 fallback track in case the BluRay player or the sound system aren't compatible with the format, and I suspect the second audio track on the list (third one counting the video track) you sent might be it.

Dolby TrueHD is a lossless codec and since Subler can't pass it through to the mp4 Container it has to transcode it into something else, and transcoding means loss of quality.
